FINGER ON THE PULSE.
President William Ruto recently achieved political victories despite legal setbacks. He successfully assented to the Affordable Housing Act 2024, which now enables the government to collect a 1.5% national housing levy despite facing a court challenge on its constitutionality. Additionally, Parliament is considering the National Government Laws (Amendment) Bill 2023, which, if passed, would empower him to appoint an unlimited number of Chief Administrative Secretaries (CAS), a move previously deemed unconstitutional by the courts.
This progress comes in the wake of the ruling of the Constitutional and Human Rights Division of the High Court of Kenya in Petition No E080 of 2023, Eliud Karanja and others vs The Republic of Kenya and others, commonly referred to as the Chief Administrative Secretary (CAS) case 2023, which declared the Office of Chief Administrative Secretary unconstitutional.
