Wajir East MP Aden Daudi, Sponsor of the Computer Misuse and Cybercrimes Act, 2025
The past week has seen a series of constitutional petitions challenging the recently enacted Computer Misuse and Cybercrimes Act, 2025. Several petitions contest provisions expanding the definition of cyber harassment, including conduct likely to cause suicide, and the wider powers granted to the National Computer and Cybercrimes Coordination Committee (NC4). Directions for assessing the constitutionality of the Act have been scheduled for early November.
Wajir East Member of Parliament (MP) Aden Daudi, the sponsor of the Bill, has defended its significance and constitutionality. He has described it as a necessary step to deter extremism, protect children from online exploitation, and enhance national cyber resilience within the framework of the Constitution.
Hon. Daudi is an accomplished legal professional with a broad career that includes public service, private practice, and international experience. He holds a Post-Graduate Diploma in Law from the Kenya School of Law (2007), a Juris Doctor degree from the William Mitchell School of Law in the United States (2003), a Master of Arts in International Development Studies from St. Mary’s University in Canada (1999), and a Bachelor of Education in Economics from Kenyatta University (1988).
From 2011 to 2022, he served as a Partner at Michael, Daud & Associates Advocates. Prior to that, between 2008 and 2010, he was a Partner at Ahmednasir Abdikadir & Company Advocates. His leadership extended into public service as Chairman of the Board of Trustees of the National Social Security Fund (NSSF) from 2009 to 2015. Earlier in his career, he gained considerable courtroom experience as a Defender with the Minnesota State Public Defender’s Office in the United States between 2005 and 2007.
He is a member of the Law Society of Kenya (LSK) and the East Africa Law Society (EALS). His professional strengths include anti-money laundering compliance and legal advisory work, and his interests encompass dispute resolution, arbitration, mediation, law and justice, as well as defence, intelligence, and foreign relations.
In recognition of his distinguished service, he has been awarded the national honour of Elder of the Burning Spear (EBS).
