The Kenya National Entrepreneurs Trust—Appointment

The Cabinet Secretary for the National Treasury and Economic Planning has appointed the following individuals as Trustees to the Kenya National Entrepreneurs Savings Trust for a period of three years effective September 6, 2024:

The Land Act—Inquiry, etc.

Gerishom Otachi, Chairman of the National Land Commission, on behalf of Athi Water Works Development Agency (AWWDA), has announced an inquiry to address compensation claims related to land acquisition for the Ng’enda Water Supply Project in Kiambu County. The inquiry will be held on 26th September 2024, at Kiamwangi Chief’s Office, starting at 10:00 a.m. Affected landowners, are required to submit written claims for compensation along with identification, land ownership documents, and banking details before the inquiry date. Submissions can be made at the NLC office in Nairobi or the NLC County Co-ordinator’s Office in Kiambu County. 

The Civil Aviation Act—Decisions of the Kenya Civil Aviation Authority on Applications for Air Service Licences

The Kenya Civil Aviation Authority (KCAA) has issued decisions on various applications for air service licenses as per the Civil Aviation Act, 2013, and related regulations. Notable approvals include Safari Plus Limited and Prime Aviation Limited, which received variations to their existing licenses, and Coastal Travels Limited and Auric Air Services Limited, granted licenses for international non-scheduled services between Tanzania and Kenya. Reliance Air Charters Limited was granted a license for domestic and international non-scheduled services, excluding some routes. Several other companies, such as Photomap (K) Limited, Flex Air Charters Limited, and Aberdair Aviation Limited, received licenses for domestic and international services, including non-scheduled passenger, cargo, and aerial work services, with varying validity periods. 

The Proceeds of Crime and Anti-Money Laundering Act—Preservation Orders

Preservation Orders Against Latif Mohamed Dawood and Khan Mohamed Ashraf Changu

The High Court of Kenya has issued preservation orders against Latif Mohamed Dawood and Khan Mohamed Ashraf Changu under the Proceeds of Crime and Anti-Money Laundering Act, 2009. The order prohibits the sale, transfer, or disposal of motor vehicles KDJ 814A (Mazda Demio) and KDH 560Q (Mazda Demio). The respondents are directed to surrender the original logbooks and keys to the Applicant within seven days. A caveat will be registered against the vehicles, and non-compliance may lead to imprisonment for up to six months.

The Competition Act—Exemption, etc.

Exemption Granted to Kenya Airways Limited and Precision Air Services PLC

The Competition Authority of Kenya has granted an exemption for restrictive clauses in the Joint Venture Agreement between Kenya Airways Limited and Precision Air Services PLC for six years. The exemption covers clauses on code sharing, network management, pricing of ticket fares, revenue management, and joint marketing and sales activities.

Acquisition of Ramoda Ceramics Limited Assets by KEDA (Kenya) Ceramics Limited

The Competition Authority of Kenya has authorised the acquisition of certain assets of Ramoda Ceramics Limited by KEDA (Kenya) Ceramics Limited under the provisions of the Competition Act.

Acquisition of Suntory Beverage and Food Kenya Limited and Bidcoro Africa Limited

The Competition Authority of Kenya has authorised the acquisition of the entire issued share capital of Suntory Beverage and Food Kenya Limited and Bidcoro Africa Limited under the provisions of the Competition Act.

Acquisition of 51% Shareholding in Monarch Insurance Limited

The Competition Authority of Kenya has authorised the acquisition of 51% shareholding in Monarch Insurance Limited by Ondoba Limited, Kenyoro Limited, and Equico Thirteen Limited under the provisions of the Competition Act.

The Companies Act—Restoration, etc.

The Registrar of Companies, Joyce Koech, has restored several companies to the Register of Companies. This restoration takes effect from the date of the notice’s publication on 27th August 2024.

The Insolvency Act—Appointment of Liquidator

Appointment of Liquidator for United Insurance Company Limited

Under the Insolvency Act, 2015, Kamal Anantroy Bhatt has been appointed as the Liquidator for United Insurance Company Limited by the High Court of Kenya, effective 16th July 2024. The company, located at Anniversary Towers, University Way, Nairobi, is involved in insurance. Creditors must submit their claims to the Liquidator by mail to P.O. Box 80766–80100, Mombasa, or they risk exclusion from future distributions.

Liquidation of Delta Construction Company Limited

The Official Receiver has been appointed as the Liquidator of Delta Construction Company Limited following a court judgment on 12th April 2024. Creditors must submit their claims by 12th October 2024 via www.brsv2ecitizen.go.ke or risk exclusion from any distributions. Contact the Official Receiver, Mark Gakuru, for details.

 

The Co-operative Societies Act—Extension of Inquiry Period

 

An inquiry into the affairs of Kilimo Services Sacco Society Limited (CS/14828), originally ordered on 16th August 2024, has been extended by an additional five days from 9th September 2024 due to incomplete findings. The inquiry is conducted by authorised officials including CPA Peter K. Wanjohi and others.

The Environmental Management and Co-ordination Act—Environmental Impact Assessment Study Reports

Environmental Impact Assessment for Proposed Residential Apartments in Westlands

The National Environment Management Authority (NEMA) has received an Environmental Impact Assessment (EIA) report for the proposed construction of residential apartments by Kawamax Company Limited on Plot L.R. No. 209/64/15, Mogotio Road, Westlands, Nairobi. The 24-storey building will include 312 units and various amenities. Anticipated impacts include air pollution, noise, soil disturbance, and increased water and energy demand. Proposed mitigation measures include water spraying, restricted construction times, use of personal protective equipment, and waste management protocols. Public comments are invited within 30 days of notice publication.

Gazette Notice No. 11256 – EIA Report for Proposed Residential Development on Mogotio Road, Westlands

Brilight Investment Limited proposes a residential apartment block on Plot L.R. No. Nairobi/Block 34/187, Westlands, Nairobi. The project will include various apartment units, parking, and recreation facilities across multiple floors. Anticipated environmental impacts include soil erosion, vegetation loss, noise, air pollution, and increased water demand. Mitigation measures include installing drainage structures, using dust control methods, proper waste management, and ensuring security measures. The public is invited to review the full EIA report and submit comments within 30 days from the publication date.
