The objective of the Bill is to establish an Act of Parliament to provide for the control and licensing of betting, casinos and other forms of gaming, authorization of prize competitions and public lotteries, for the establishment of the National Lottery, for imposition of a tax on gaming and for connected purposes.

The Gaming Bill seeks to repeal the Betting, Lotteries and Gaming Act Cap 131, an Act of Parliament that has been in existence since 1966. The Bill further seeks to address various inadequacies in the existing Act. The Bill establishes the Gaming Authority and the National Lottery Distribution Trust Fund.

The main purpose of the Bill is to consolidate the law relating to conduct of referenda and to provide for a transparent and fair process of determining the will of the people. The Bill hopes to achieve this by:

establishing the procedures for the conduct of referenda
providing for the referendum committees
establishing a level playing field for the opposers and supporters of a referendum question, by providing for equal public funding and by limiting expenditure in a reasonable manner for the public good, to afford the people an opportunity to make decisions based on information from both points of view.

The 2010 Constitution of Kenya does not provide details on how a referendum can be conducted. The current law relating to referenda is captured in Part IV of the Elections Act. However, the provisions are inadequate and there was need for a comprehensive stand-alone legislation that deals with referenda.
