Following an investigation into the 2022 government acquisition of Telkom Kenya Ltd. for 6 billion Kenyan shillings, the Ethics and Anti-Corruption Commission (EACC) has called for charges against nine individuals. These include former high-ranking officials from the Treasury Ministry, the Controller of Budget, Telkom Kenya leadership, and an advisor to Helios Investments, the previous owner.
The EACC alleges serious irregularities in the deal. Most notably, the Communication Authority, the body responsible for overseeing telecommunications, reportedly never approved the takeover. Additionally, the investigation has pointed out that the Office of the Attorney General, which typically provides legal advice on such significant transactions, was neither consulted nor did it offer its legal opinion. Finally, the EACC argues that the purchase breached financial regulations concerning unforeseen expenses, suggesting the deal may not have been properly justified.
This development raises serious questions about the transparency and legality of the Telkom Kenya acquisition. The EACC’s recommendations, if acted upon by the Director of Public Prosecutions, could lead to significant legal proceedings and potentially expose a major corruption scandal.
