New rules for Data Protection

The Officer of the Data Protection Commissioner released Draft Data Protection Regulations earlier this week for public participation.

The Regulations comprises:

  • The Data Protection (Compliance and Enforcement) Regulations – The Regulations outline the compliance and enforcement provisions for Data Commissioner, Data Controllers and Data Processors.
  • The Data Protection (General) Regulations, 2021 – They provide for the procedures for enforcement of the rights of the data subjects, use of personal data, obligations of data controllers and processors, elements of data protection, conduct of data protection impact assessment, exemptions and offences among other things.
  • The Data Protection (Registration of Data Controllers and Data Processors) Regulations, 2021- The Regulations provide for the procedure for registration of data controllers and data processors

Invitation for Comments on the draft data regulations

The Stakeholders have been invited to submit their inputs and comments and send them orally or via a written memorandum and send to the email address – dataprotectionregulations@odpc.go.ke  The deadline for submissions is Tuesday 27th April, 2021 at 12:00noon.

Members of the Public have also been invited to a public virtual hearing happening on 27th, 28th and 29th April at 2:00PM.
